Suspects in lynching of grannies plead not guilty

Six suspects accused of lynching four elderly women over suspicions of practicing witchcraft in Marani Sub County, Kisii will remain in custody for ten more days after pleading not guilty to four counts of murder.

The suspects, Amos Nyakundi Ondieki, Chrispine Makwaro Ogeto, Peter Angwenyi Gwanga, Brian Mecha Nyakundi, Ronald Ombati Onyonka and Justin Morara appeared before Kisii High Court Judge Rose Ougo charged with murdering Sindege Mayaka, Rael Sigara Onkware, Agnes Moraa Ototo and Jemima Nyangate Mironga contrary to section 203 of the Penal Code.

Justice Ougo ruled that five of the suspects be remanded at Kisii GK Prisons and the sixth at Manga Children’s Home in Nyamira as he was a minor, pending bond application hearing set for November 9.

The suspects had through their lawyer Shaffin Kaba, applied for bond but the prosecution led by Hillary Kaino opposed citing growing tension in the areas where the murders took place.

 “It is our position that the issues of bond can be heard later after getting a social inquiry report on the situation on the ground. Also, there are other suspects still at large and such the Directorate of Criminal Investigation (DCI) Officers are still carrying out further investigations,” Kaino added.

However, Lawyer Kaba argued there was no affidavit to support the issues raised by the Prosecution that he stressed was acting on assumptions instead of evidence.

“It is the right of the accused persons to be granted bail unless there is an exceptional circumstance presented by the prosecution,” argued Kaba.

Concurring with the lawyer, Justice Ougo instructed the prosecution to present a sworn affidavit within three days with compelling reasons why the six accused should be denied bail.
